"Supreme Court denies Warner Bros. appeal in Ladd case
EXCLUSIVE: The California Supreme Court today denied Warner Bros.' appeal of its long-running legal battle with producer Alan Ladd Jr. over license fees from "Blade Runner, "Chariots of Fire" and the "Police Academy" series, paving the way for Ladd to enforce a $3.2 million jury verdict against the studio.
As you'll recall, Ladd convinced a jury in 2007 that Warners underpaid license fees owed to his Ladd Co. by bundling his popular films together with some stinkers and licensing them in bulk, then allocating a massive license fee across all the films in the package.
Warners appealed the verdict, arguing that Ladd had failed to prove a breach of contract and that the damages calculations weren't supported by the evidence or the testimony of Ladd's expert. The appeals court in May sided with Ladd, while sending a few issues back to the trial court.
Warners then appealed to the state Supreme Court, which today declined to hear the appeal.
That means Warner Bros. will have about 30 days to pay the judgment (about $4.3 million now, with interest).
The remaining issues go back to the trial court, unless the parties can work out a settlement.
"It's what we expected," Ladd lead lawyer John Gatti tells us. Warner Bros. declined to comment. "
